A.Q.C.O. and Gareau v. Brigil

Class action for missing sewer backwater valves — approximately 2,500 BRIGIL condo owners and tenants

Current status 550-06-000033-242

Case Summary

The Association pour la qualité dans la construction en Outaouais inc. (AQCO), a non-profit association supported by ABC Avocats, is claiming $38 million on behalf of approximately 2,500 owners and tenants of BRIGIL condos built over a 20-year period (1996 to 2016).

According to the allegations contained in the claim filed with the court, the BRIGIL real estate developer allegedly built nearly one hundred buildings comprising more than 1,000 condos without ensuring that the sewage drain lines were equipped with backwater valves — devices essential for preventing sewer backflow.

The APCHQ new home warranty plans and the Régie du bâtiment du Québec are also named as defendants for having grossly failed in their responsibilities, including by failing to ensure the existence of plumbing plans and specifications and by neglecting to conduct mandatory inspections during the construction period.
