Case Summary
The plaintiff alleges that the defendant parties are responsible for damages caused by construction defects and poor workmanship in the buildings. Occupants suffered a loss of enjoyment of their condos during corrective work (noise, dust, loss of access to certain rooms, loss of balcony, invasion of privacy, stress, etc.).
The plaintiff and defendant parties negotiated and ultimately agreed to a settlement after thorough evaluation of the facts and law. A settlement was reached on behalf of the group members, defined as follows:
- Group members: All occupants of the Properties during the corrective work period from May 1, 2016 to March 31, 2019.
- Properties covered: The 96 units located at 240, 260, 270, 280, 290, 300 and 310 boul. de l'Europe and 155 rue de Londres in Gatineau.
While the defendant parties deny any wrongdoing or liability, they agreed to settle in order to avoid litigation.
